Standard Terms and Conditions of Engagement:
No fee will be incurred by Motor Industry Bargaining Council until the successful Applicant commences the engagement, and only then will the Agency render an invoice to Motor Industry Bargaining Council for its fees. The fee is based on a percentage of the Gross Annual Remuneration Package (GARP) offered to the Applicant that is introduced, and has the entire recruitment process facilitated, to Motor Industry Bargaining Council by the Agency. The GARP shall include all taxable benefits referred to in Schedule 7 of the Income Tax Act No. 58 of 1962 (as amended), gross salary inclusive of ‘13th cheque’, any fee or allowance, Value Added Tax (VAT) and excluding performance bonuses and commissions. In all activities associated with resourcing, the Agency acts in the capacity as Agent of its Client and is not deemed to be the employer of the Applicant referred for consideration for permanent positions. Only duly authorised personnel may accept the services of the Agency and hence the Agency fees. Should an Agency submit an applicant that is already contained with the Motor Industry Bargaining Council candidate database, and Motor Industry Bargaining Council subsequently hires the applicant, no fees, in accordance with the terms of this agreement, will become due and payable to the Agency.
Standard Fees:
Gross Annual Remuneration % Fee (excluding VAT) will not exceed 14% and will include a guarantee period on 90 days

Skills assessments (where applicable)

Reformatting of short listed CV’s to a standard “easy to read” format
Credential verification
References
ID/Credit/Criminal checks
Client/Applicant interview co-ordination
Debriefing of both Applicant and Client
Offer presentations
Offer negotiating and counselling
Declining all unsuitable Applicants as per LRA requirements
Guide successful Applicant during the notice period
Performance management of successful Applicant during the guarantee period
Problem solving and advice during the guarantee period
Engagement / Re-Engagement of CV's:
Should Motor Industry Bargaining Council or subsidiary or associate of Motor Industry Bargaining Council or supplier or any other person related to Motor Industry Bargaining Council engage or re-engage an Applicant/Contractor after a period of twelve (12) months from the date of introduction or termination, no fees, in accordance with the terms of this agreement, will become due and payable to the Agency.
Guarantee:
Should the Applicant, within the guarantee period of 90 days from commencement of employment, resign or be legitimately dismissed, the Agency will refund 100% of the fee already invoiced to Motor Industry Bargaining Council within 7 days of the placed applicant resigning or being legitimately dismissed .. It is further agreed that the Agency is not liable for any losses incurred by the Applicant to the Client’s business.
